Our Approach
The attorneys in BHF's Banking and Finance practice area have decades of experience representing local community banks, national banks and international lenders and other financial institutions. Due to our experience in a wide variety of lending situations and different types of secured and unsecured loans, we handle matters expertly and efficiently, using a minimum number of attorneys to control costs and provide timely and effective services. We provide loan documentation, diligence review and closing services as well as loan recovery and workout services for clients in transactions ranging from small business loans to middle market credits to commercial real estate matters to bond finance deals to large, complex syndicated loan transactions.
Services
Asset-Based Lending
We represent asset-based lending departments of major financial institutions in the greater Boston area and act as counsel for several national asset-based lending institutions.
Commercial Real Estate Lending
In addition to our traditional real estate services for developers, investors, buyers and sellers of real estate, we serve lenders involved with commercial real estate loans, including acquisition, construction, bond finance and traditional term lending in the office, retail, housing, health care and other real estate markets.
Commercial and Industrial Lending
We represent private, institutional, public and quasi-public lenders in the documentation and negotiation of revolving lines of credit, equipment loans, term financing, letters of credit and other commercial lending products involving borrowers in many different industries and locations.
Small Business Administration Lending
We assist various small business lending teams at local banks or with national lending platforms in the documentation and closing of SBA guaranteed 7(a) term loans, lines of credit, 504 loans and Express facilities. We are also very experienced in assisting lenders with the negotiation and closing of the workouts of accords and satisfactions of defaulted loan matters with the focus on preserving the lender's rights under the SBA Guaranty and the maximum recovery for the SBA.
Subordination and Inter-Creditor Arrangements
We are very experienced in the negotiation and documentation of a variety of inter-creditor and/or subordination arrangements with different state agencies, quasi-public entities, equity sponsors or other sub-debt holders providing mezzanine or other junior financing.
Participations; Syndications
We continue to be involved in numerous transactions representing lenders on both a participation and syndication basis for asset-based, unsecured, secured and real estate loans.
Restructuring Finance Transactions
We handle loan workouts, liquidations, foreclosures, deeds in lieu of foreclosure, UCC secured party sales, lender liability defense strategies and the negotiation of settlement or forbearance arrangements for troubled loans.
